1. Ordering Goods, Moment of Establishment of Legal Relations of the Purchase Agreement
1.1. The Buyer may order Latvian Potter goods in one of the following ways:
1.1.1. online at latvianpotter.lv;
1.1.2. by telephone;
1.1.3. at the workshop (hereinafter referred to as the “Workshop”).
1.2. When ordering goods in one of the methods specified in Clauses 3.1–3.2 of the Terms, the Buyer must provide in the relevant information fields of the latvianpotter.lv system the personal data necessary for proper order fulfillment, which are processed by latvianpotter.lv in accordance with the Privacy Policy.
1.3. Orders placed by telephone or at the Workshop are fulfilled in accordance with the Terms and are subject to the Privacy Policy. By placing an order, the Buyer agrees to the Terms and their application.
1.4. When the Buyer has selected a product or service, created a shopping cart, and completed all order steps, the last of which is the selection and confirmation of the payment method, it is deemed that a purchase legal relationship has been established between the Seller and the Buyer and that a purchase agreement has been concluded. The Buyer is informed of the order confirmation by a notification sent to the email address provided by the Buyer. The Seller sends the Buyer a link to the current Terms and the order confirmation to the Buyer’s email address.
1.5. Each Buyer’s order is stored in the latvianpotter.lv system and the Seller’s database in accordance with the Privacy Policy.
2. Buyer’s Rights
2.1. The Buyer has the right to purchase goods and order services on latvianpotter.lv in accordance with these Terms.
2.2. The Buyer has the right to cancel an order in accordance with these Terms.
2.3. The Buyer has the right to withdraw from the Agreement in accordance with these Terms.
2.4. The Buyer has the right to exchange or return purchased goods in accordance with these Terms.
2.5. The Buyer has other rights set out in these Terms, the Privacy Policy, the latvianpotter.lv Terms of Use, and the laws of the Republic of Latvia.
3. Buyer’s Obligations
3.1. When using latvianpotter.lv, the Buyer must fulfill their obligations, comply with these Terms, the Privacy Policy, the latvianpotter.lv Terms of Use, and other rules clearly indicated on latvianpotter.lv, and must not violate the laws of the Republic of Latvia.
3.2. The Buyer must pay for ordered goods or services and accept them in accordance with these Terms. If the Buyer chooses to collect the goods at the Workshop, the Buyer must pick them up within the time period specified in the Terms.
4. Seller’s Rights
4.1. The Seller and latvianpotter.lv have the right to cancel the Buyer’s order without prior notice if the Buyer selects the payment methods specified in Clauses 6.2.1 or 6.2.2 and does not pay for the goods within 3 (three) business days.
4.2. If there are uncertainties regarding the order information, the Seller has the right, via latvianpotter.lv, to contact the Buyer using the contact details provided in the order. In this case, the delivery period starts from the day the Seller contacts the Buyer. The Seller has the right to cancel the order without prior notice if:
a) the Seller is unable to contact the Buyer within 2 (two) business days after the order is submitted; or
b) the Buyer fails to provide the requested information within the Seller’s specified deadline; or
c) the Buyer does not give consent for verification of personal data.
5. Seller’s Obligations
5.1. The Seller undertakes to fulfill Buyer orders in accordance with these Terms and to communicate with the Buyer using the contact information provided on latvianpotter.lv, and not to communicate through other channels except where expressly stated in these Terms or on the website.
5.2. The Seller undertakes to provide the Buyer with information required under Article 6.228-7 of the Civil Code of the Republic of Latvia in a clear and understandable manner within the latvianpotter.lv system.
5.3. The Seller and latvianpotter.lv undertake to respect the Buyer’s privacy and process personal data only in accordance with these Terms, the Privacy Policy, the Terms of Use, and applicable Latvian and European Union laws.
5.4. latvianpotter.lv undertakes to inform the Buyer before placing an order about the suspension or termination of platform functions that are significant for order fulfillment, as well as about changes specified.
5.5. In accordance with these Terms, the Seller undertakes to deliver the ordered goods to the Buyer and accept returned goods.
5.6. If the Seller is unable to deliver the ordered goods due to important circumstances, latvianpotter.lv may offer similar or equivalent goods, informing the Buyer via phone, SMS, or email. If the Buyer does not agree, the Seller shall refund the payment within 14 (fourteen) business days (if prepayment was made) and cancel the order.
5.7. If the Buyer agrees within 3 (three) business days to a replacement product from another Seller, the original Seller shall refund the Buyer for the undelivered goods and compensate any price difference.
5.8. If the Seller does not agree with the Buyer’s claims, the Seller must provide a written, reasoned response within 14 (fourteen) calendar days, unless otherwise provided by law.
5.9. The Seller undertakes to fulfill all other obligations imposed by these Terms and applicable laws.
6. Prices, Payment Procedure and Terms
6.1. Prices on latvianpotter.lv are indicated in euros, including applicable taxes where relevant.
6.2. The Buyer may pay for the ordered goods using one of the following methods (availability may be limited and the final payment options are shown for each order):
6.2.1. bank transfer;
6.2.2. payment card;
6.2.3. cash or card payment upon receipt of goods at the Workshop pickup point.
6.3. By accepting the Terms, the Buyer agrees that purchase documents (invoices, which also serve as warranty documents) may be issued physically together with the goods or electronically to the email address provided in the registration form immediately after order fulfillment. Invoices include seller details, selected goods, quantity, discounts, total price including all taxes, and other information required by accounting regulations.
6.4. After order confirmation by the Seller, the price may change only in exceptional cases due to technical system errors, correction of obvious mistakes, or other objective reasons beyond the Seller’s control. If the Buyer does not agree with the new price, the Buyer may cancel the order within 2 (two) business days by informing the Seller via the contact details provided on latvianpotter.lv. In such case, the Seller shall refund all amounts paid for the canceled order.
7. Delivery of Goods
7.1. When ordering Goods, the Buyer may choose one of the delivery methods specified in the description of the particular Goods sold by the Seller.
7.2. If, when placing the order, the Buyer chooses home delivery of the Goods:
7.2.1. The Buyer undertakes to specify the exact place of delivery of the Goods.
7.2.2. The Buyer undertakes to accept the Goods personally. A valid identity document (ID card or passport) must be presented at the time of receipt of the Goods. If the Buyer does not personally accept the Goods, even though they have been delivered to the address specified by the Buyer, the Seller has the right to hand over the Goods to another person present at the specified address, and the Buyer shall not have the right to raise any claims against the Seller regarding delivery to the wrong person.
7.2.3. The Goods are delivered by the Seller or its authorised representative.
7.2.4. The delivery fee for home delivery does not include carrying the Goods above the first floor – this service may be ordered separately by the Buyer.
7.3. If, when placing the order, the Buyer chooses to receive the Goods at one of the Latvian Post offices:
7.3.1. The Buyer may collect the Goods at a Latvian Post office after paying the specified purchase price and delivery fee. If the Buyer does not pay the stated fee, the Goods will be returned to latvianpotter.lv.
7.3.2. The ordered Goods must be collected no later than within 3 (three) working days after the courier has informed the Buyer by email or SMS that the Goods are ready for collection.
7.3.3. The Goods may be collected not only by the recipient specified in the order but also by another person indicated at the time of placing the order. A valid identity document (ID card or passport) must be presented to the Latvian Post employee.
7.3.4. Collection of Goods at Latvian Post offices is not possible in the following cases:
7.3.4.1. If the total weight of the ordered Goods exceeds 20 kg.
7.3.4.2. If the size of the ordered Goods makes it impossible to provide this service.
7.4. The Buyer may collect the Goods free of charge at the Workshop. If this option is chosen:
7.4.1. The Goods must be collected no later than within 3 (three) working days after the Seller has informed the Buyer by email that the Goods are ready for collection.
7.4.2. The Goods may be collected only by the person who placed the order or the person specified at the time of ordering. A valid identity document (ID card or passport) must be presented to the latvianpotter.lv employee.
7.5. If the Buyer chooses delivery via Omniva parcel locker or Latvian Post office:
7.5.1. Omniva parcel lockers can be used for Goods not exceeding 30 kg.
7.6. Delivery terms indicated in the product description are provisional. The Seller delivers Goods in accordance with the estimated timeframes indicated in the product descriptions. Delivery terms do not apply if the Goods are unavailable in the Seller’s warehouse and the Buyer is informed about the unavailability. By accepting these Terms, the Buyer agrees that in exceptional cases delivery may be delayed due to unforeseen circumstances beyond the Seller’s control. In such cases, the Seller undertakes to promptly contact the Buyer and agree on a new delivery time and other conditions. If the Seller fails to deliver the Goods within the specified time and the parties do not agree on an additional delivery term, further conditions apply.
7.7. The Seller is released from liability for breach of delivery deadlines if the Goods are not delivered or are delayed due to third parties not connected to or dependent on the Seller, or due to circumstances attributable to the Buyer.
7.8. At the time of delivery, the Buyer must inspect the condition of the shipment and Goods together with the courier, or in the case of pickup at the Workshop, with latvianpotter.lv or its authorised representative, and sign the handover-acceptance document. By signing, the Goods are considered delivered in proper condition, without damage not related to manufacturing defects or discrepancies in completeness visible upon external inspection. If damage or incomplete delivery is detected, the Buyer must note this in the document and, together with the courier or representative, draw up a free-form report. Otherwise, the Seller is released from liability for externally visible defects.
7.9. The risk of accidental loss or damage to the Goods passes to the Buyer upon delivery of the Goods to the Buyer.
7.10. If the Buyer fails to collect the Goods within the specified time, and has paid for them and delivery, the Seller will contact the Buyer to agree on a new delivery time/method. If the Buyer still does not collect the Goods, they are returned to the Seller, the order is cancelled, and the payment is refunded minus bank transfer fees, delivery costs (if applicable), and administrative fees.
7.11. If the Buyer has not paid for the Goods and fails to collect them, the Goods are returned to the Seller and the order is cancelled.
8. Quality Guarantee and Expiry Terms
8.1. The characteristics of each product sold at latvianpotter.lv are indicated in the respective product description. The Goods offered by the Seller are of appropriate quality. A product complies with the consumer sales contract if:
8.1.1. it matches the description provided by the Seller and has the same characteristics as the sample or model used in advertising;
8.1.2. it is suitable for the purposes for which goods of the same type are normally used;
8.1.3. it meets the quality standards normally expected for goods of the same type and which the Buyer can reasonably expect based on public statements, advertising, or labelling by the manufacturer or Seller.
8.2. The Seller provides a specific quality guarantee period for different types of Goods. The exact term and conditions are specified in product descriptions or invoices.
8.3. The Seller’s quality guarantee does not limit statutory consumer rights in case of non-conforming goods.
9. Right to Withdraw from the Contract, Return and Exchange of Goods
9.1. Right of withdrawal:
9.1.1. A Buyer who is a consumer has the right to withdraw from the contract within 14 (fourteen) days without stating any reason, by notifying the Seller or latvianpotter.lv. This right does not apply in cases specified in Latvian Cabinet Regulation No. 255 of 20 May 2014.
9.1.2. The Buyer must notify withdrawal by sending an email or clear statement to latvianpotter.lv. Confirmation of receipt is sent to the Buyer.
9.1.3. The 14-day withdrawal period is calculated from:
a) receipt of the Goods by the Buyer or a designated person;
b) receipt of the last item if multiple items are delivered separately;
c) receipt of the last batch if delivered in parts;
d) receipt of the first item in case of regular deliveries.
9.1.4. If withdrawal is made before delivery, the Buyer must notify latvianpotter.lv and the order is cancelled.
9.1.5. If withdrawal occurs after delivery, Section 11.6 applies.
9.2. Additional refund guarantee by the Seller.
9.3. Exchange and return of non-conforming goods:
9.3.1. Defects are remedied, and defective goods are replaced or returned in accordance with applicable laws.
9.3.2. If goods are defective, the Buyer may choose:
- repair;
- replacement;
- price reduction;
- replacement with equivalent goods;
- refund and contract termination (if breach is significant).
9.3.3. The Buyer may first request repair or replacement unless impossible or disproportionate.
9.3.3.2. The Buyer may request price reduction or contract termination if issues are not resolved within a reasonable time.
9.3.3.3. Minor defects do not justify contract termination and refund.
9.4. Return obligations:
The Buyer must notify the Seller, provide proof of purchase, and submit a request.
9.4.5. Returns may be made within the warranty period.
9.4.6. The Buyer pays return costs initially; these are refunded if defect is confirmed.
9.4.7. Refund is not issued for intentionally or negligently damaged goods or improper use.
9.5. Incorrect goods delivered:
The Buyer must notify within 7 working days. The Seller replaces goods or refunds within 14 days.
9.6. Return procedure:
Goods must be unused, in original condition, and properly packed. Complete sets must be returned in full. Refunds are processed within 14 days after receipt of withdrawal notice or returned goods.
10. Liability
10.1. The Buyer is responsible for any unlawful actions carried out using latvianpotter.lv.
10.2. Upon registration, the Buyer is responsible for the storage and/or transfer of their login credentials to third parties. If services provided by latvianpotter.lv are used by a third party logging into latvianpotter.lv using the Buyer’s login details, the Seller shall consider that person to be the Buyer.
10.3. The Seller is released from any liability in cases where losses arise because the Buyer, despite the Seller’s recommendations and their own obligations, has not familiarised themselves with these Terms and the Privacy Policy, and the terms of use of latvianpotter.lv, even though such an opportunity was provided.
10.4. If latvianpotter.lv contains links to third-party websites, latvianpotter.lv does not guarantee that the information available through those links is accurate, complete, or correct. The third parties are responsible for the content, accuracy, completeness, and correctness of the information provided on their websites.
